Nigeria’s Attorney-General of the Federation (AGF) and Minister of Justice, Abubakar Malami, is currently sponsoring a bill before the National Assembly to take over prosecuting and investigative powers of all the law enforcement agencies in the country.
SaharaReporters gathered that the move by Malami is to stall the prosecution of high-profile corruption and criminal cases in order to protect his allies from facing justice.

The bill tagged “The Prosecution Of Offences in Nigeria Act, 2017” if passed into law by the National Assembly will allow the office of the AGF to take over the conduct or discontinue criminal proceedings.
“Responsibilities to institute or take over the conduct of proceedings. Procedural requirements for taking over of criminal proceedings,” Part V of the bill seen by SaharaReporters read.
“Procedural requirements for discontinuance of proceedings. Discontinuance of proceedings after accused has been sent for trial.
“Assuming Conduct of prosecution by the Attorney-General. Review of prosecution powers of law enforcement agencies etc. Review of investigations conducted by law enforcement agencies.
“Power to conduct investigation. Power under the Extradition Act. Conduct of criminal proceedings by persons other than a Prosecuting Officer.”
Part V Section 20(1)(a)(b) further stated in part, “Subject to the exercise of the powers of the Attorney–General for public prosecutions under the Constitution and the provisions of other applicable laws, rules or regulations and notwithstanding the provisions of Part II of the Administration of Criminal Justice Act, 2015 on the control of criminal proceedings, the Prosecution Authority, under the directions of the Director shall, with effect from the date of commencement of this Act, be responsible for – conducting criminal proceeding against any accused person before any court in Nigeria in respect of any offence created by or under any Act of the National Assembly; taking over the conduct of criminal proceedings, instituted by any law enforcement agency, including the Police.”

Part V Section 24 is titled ‘Assuming conduct of prosecution by the Attorney-General’.
The section says, “Notwithstanding the provision of this Act, or any other power conferred on the Director under this Act or any other Act, the Attorney-General may after notifying the Director, intervene in the first instance or on appeal where, in the opinion of the Attorney-General, the proceedings raise questions of public interest.
“The Attorney-General may only assume conduct of a prosecution after consulting the Director on the matter and giving notice to the Director of his intention to assume conduct of the prosecution.
“On the receipt of the notice referred to in subsection (2) of this section, the Director shall turn the prosecution file over to the Attorney-General and provide any information that the Attorney-General may require on the matter within the time specified.”

SaharaReporters gathered that the bill is expected to be presented to heads of law enforcement agencies tomorrow (Tuesday, August 31, 2021) at a meeting convened by the Administration of Criminal Justice Act (ACJA) Monitoring Committee Secretary, Sulayman Dawudu.
They are to be blackmailed, intimidated and forced to endorse the ‘satanic’ bill secretly sponsored by the AGF, a source told SaharaReporters.
“Malami to re-enact the surreptitious takeover of the prosecution of corruption cases in the country and return it to ground zero,” the source added.
“The publicly criticised bill on creation of public prosecution authority, prepared in 2017 has resurfaced within the government by the Ministry of Justice through its ACJA monitoring Committee, Secretary, Sulayman Dawudu.
“This bill purporting to take over all prosecuting and investigative powers of all the law enforcement agencies in the country is to be presented to the law enforcement agencies tomorrow Tuesday, August 31, 2021 at a meeting convened by the ACJA monitoring committee to blackmail and intimidate leaderships of the law enforcement into endorsement.
“The bill is in all intent, purposes and activities in contravention of international standards in the fight against corruption; it leaves the fight against corruption in the control and manipulation of a political appointee in the person of Attorney General; it creates another agencies with investigation and prosecution over and above trained law enforcement agencies; it conflicts with the laws establishing all the law enforcement agencies; and will frustrate and demoralise the law enforcement agencies.
“The Attorney General who had bared his fangs recently with the withdrawal of his political associates like Danjuma Goge and others will have the express power to kill cases where he has interests.”

Implications Of Having The ‘Satanic’ Bill Passed
Identifying some of the implications of having the bill passed into law, an expert in legal matters noted that the “bill essentially kills the independence of the ACAs (Anti-Corruption Agencies), whereby they will be subservient to other authorities in the course of their investigation and or prosecution”.
The expert further noted, “The track records on investigation and prosecution of the office of the HAGF (Honourable Attorney General of the Federation) are nothing to write home about in comparison to the stellar prosecutorial outcomes of the Anti-Corruption Agencies (ACAs), especially the EFCC.
“Consequent to the above, the incompetent cannot school or attempt to school the competent.
“This is creating another bureaucracy in the face of crushing debt profile of Federal Government of Nigeria and rather insensitive at this time.
“The progenitor, who is attempting to resurrect this bill, ought to face his primary responsibility of monitoring the Administration of Criminal Justice Act rather than creating unnecessary administrative chasms just as he tried to do with the botched EFCC repeal and establishment bill that the HAGF had to publicly dissociate himself from.
“The Office of the DPP (Directorate of Public Prosecutions) is already there as well as that of the Solicitor General of the Federal Government of Nigeria and this bill will be superfluous in the face of these and also, the Legal Departments and Investigators within the ACAs will be certainly thrown into confusion if this bill sees the light of day.
“The political backlash of this will be a major distraction for Mr. President, as this will clearly be seen as immoral when you attempt to give such sweeping powers to a card-carrying politician and political appointee.
“If the office and person of the Attorney General was separated from the office and person of the Minister of Justice, then certain aspects of the proposal may be considered, but when one person is holding the two offices, this bill cannot but be used as a political tool to tie the hands of the ACAs, embark on political vendettas or even frustrate many high profile cases of perceived party faithful.
“If this process or workshop or meeting tomorrow is being sponsored by any development partner such as ROLAC, etc, they should be alerted that they are indirectly meddling with the fight against corruption and the process of instituting good governance and accountability in the country.”

Some soldiers had killed three policemen in Taraba State while Wadume was being taken to the police headquarters in Jalingo, the state capital.
Wadume was later re-arrested in Kano and is facing prosecution alongside Tijjani Balarabe, an army captain; and 18 others on a 16 counts bordering on terrorism by the Inspector-General of Police, Mohammed Adamu.
However, the matter took a new turn when a lawyer from the Ministry of Justice, Shuaibu Labaran, informed the court that Malami would be taking over the case.
The action attracted reactions with many saying the AGF was plotting to kill the case, going by his past record.

Also in 2020, the AGF took over the money laundering trial of Akinola Ogunlewe being handled by the Economic and Financial Crimes Commission (EFCC).
At the continuation of the trial on March 10, 2020, Labaran told the court that Malami had shown interest to take over the matter.
In view of the interest shown by the AGF, counsel for the first, second, third, fourth and fifth defendants, Ebun-Olu Adegboruwa (SAN), and the prosecution counsel, Bala Sanga, agreed to return before the court on April 7, 2020 to report on an out-of-court settlement.
That was the last heard of the matter as Ogunlewe walked away a free person.
Another case taken over by Malami was the N25 billion fraud trial of Danjuma Goje, former governor of Gombe State.
The case was stalled when in an emergency hearing before Justice Babatunde Quadiri, EFCC counsel, Wahab Shittu told the court that the agency was withdrawing from the case and handing it over to the office of the Attorney-General for continuation.
The AGF, however, stated that having thoroughly reviewed the matter, he found no prima facie case while adding that it was weak.
He, therefore, withdrew the charges against Goje from the court in exercise of his constitutional power.
The withdrawal of the cases by the AGF made Goje a free man.
Another of such corruption and controversial case taken over by the office of the AGF was the alleged debts of N242 billion and $1.3bn owed by MTN for its business malpractices in the country.
MTN announced that it received through its counsel, Wole Olanipekun (SAN), a letter from the AGF formally withdrawing his demand for N242,244,452,215.97 and USD$1,283,610,357.86 alleged revenue indebtedness.
According to MTN, while the AGF had dropped his demand, he, however, referred the matter to the Federal Inland Revenue Service and the Nigeria Customs Service to resolve the controversy.
The matter has since fizzled into oblivion.
Also, in 2017, Malami ensured the withdrawal of an ongoing corruption case involving three former officials – Nasiru Ingawa (former Special Adviser on SURE-P (Subsidy Reinvestment and Empowerment Programme) to former Governor Ibrahim Shema), Abdulazeez Shinkafi (former Director of Finance and Account at the Katsina State SURE-P department) and Bello Bindawa (former Chief Store Officer in the Katsina State civil service) who were prosecuted for allegedly mismanaging N5.7 billion SURE-P funds.
However, on October 25, 2017, the Katsina State Attorney-General, Ahmed El-Marzuqat, notified the court that the state government was taking over the prosecution of the accused persons from the ICPC (Independent Corrupt Practices and Other Related Offences Commission) following a fiat from the office of the AGF to take over the prosecution of the case.
After a slow prosecution by the state government, the Katsina State High Court terminated the corruption trial of the three persons.
The AGF was also accused of stopping the prosecution of former Senate President, Dr Bukola Saraki, for allegedly forging the Senate rules to conduct the election of principal officers of the upper legislative chamber.
In 2019, the Concerned Football Patriots accused Malami of making frantic efforts to shield the President of Nigeria Football Federation (NFF), Amaju Pinnick, and other accused officials from being prosecuted for the alleged mismanagement of $9.5 million FIFA grant.
While the case was going on, Malami reportedly sent Abubakar Musa, a lawyer in his office, to pray the court for an adjournment to allow the AGF harmonise all the cases in the various courts.
After a month, the Nigerian government withdrew the case against Pinnick, NFF Secretary-General, Sanusi Mohammed; 1st Vice President, Seyi Akinwumi; 2nd Vice President, Shehu Dikko and an executive member, Yusuff Fresh.

The United States has expressed its readiness to assist Nigeria identify sponsors of terrorism in the country.
This was disclosed on Monday by the US Ambassador to Nigeria, Mary Leonard, during a meeting with journalists in Abuja.

When the envoy was asked if the US was ready to help Nigeria identify sponsors of terrorism in Nigeria, she said talks were ongoing on the matter, The Punch reports.
Leonard said, “That is something we are very eager to partner Nigeria on. I have had at least three conversations in the last two months on this subject.
“I won’t like to go into details.”
She also allayed fear that the US partnership with Nigeria might end up like that of Afghanistan.
According to her, Nigeria has had a strong bilateral relationship with the US, saying that the situations are not the same.
She added, “I hear people making the analogy with Afghanistan a lot, it does not match up.
“When you listen to what President Biden said on how troops went to Afghanistan in the first place, it was because they were in a horrible tragedy, over 3,000 Americans were killed.
“That is a different construct. The sovereign nations who have had strong bilateral relations. I don’t actually think the two match up.”
The Commander, US Air Forces in Europe, General Jeffrey Harrigian, said the purchase of Tucano fighter jets by Nigeria was an opportunity to cement the US relationship with the West African country and curb insecurity.
He said, “The A -29 Super Tucano gives us an opportunity to reconnect our relationship with Nigeria.
“It is also an opportunity to bring together the capabilities on the human side and what the A29 brings to the nation, practically as it would contribute to bringing stability to not only Nigeria but the region.”

The Chairman of the National Drug Law Enforcement Agency (NDLEA), Buba Marwa says Kano state has about two million drug addicts, representing 16 per cent prevalence.
Marwa made the disclosure on Monday when he paid a courtesy visit to the state governor, Abdullahi Ganduje.

“In Kano State, drug abuse prevalence is 16 per cent; that is, in every six persons, one is a drug addict and they are between the ages of 15 years and 64 years.
“Kano State has close to two million drug users abusing tramadol, codeine and other cough syrups, rather than cannabis.
“I will like to mention here that since I assumed leadership of NDLEA in January, we have seized over two million kilogrammes of assorted drugs, estimated at billions of naira.
“Eight thousand people were arrested and 1,600 are now serving jail terms in correctional service facilities, and we are still working.
“Drug abuse has gone to the level of destroying our families unless is tackled with all seriousness it deserves,’’ he said.
According to him, the use of drugs fuels criminal activities ranging from banditry, to kidnapping and armed robbery, among others. He said NDLEA was comfortable that Kano State government was a worthy partner in tackling drug abuse.
Marwa urged the state government to make legislation that would prevent politicians from giving drugs to youths.
He also urged the government to make legislation on compulsory drug abuse test for intending couples, also as part of measures to fight against drug abuse.
Ganduje said, “Being commercial centre, some use that opportunity to traffic drugs and you know we have the international airport, railway and roads that link to many states.
“So, Kano find itself in a vulnerable situation.”
He added that the state has a policy of testing commissioners and permanent secretaries for drug use before appointment so as to reduce the rate of drug abuse in the state.
Ganduje said his government would relocate legitimate drug dealers to a market as part of efforts to check drug abuse and trafficking.

Man Bags Six-month Jail Term For Stealing Yam Tubers In Kwara

A Kwara State Magistrates’ Court sitting in Kaiama has sentenced a 28-year-old man, Abubakar Bani, to six months imprisonment for stealing tubers of yam. Bani was arraigned by the Nigeria Security and Civil Defence Corps (NSCDC), Kwara State Command for stealing tubers of yam from farms in Tenebo village, Kaiama Local Government Area of the state. 

According to a statement by the Public Relations Officer of the state command of the NSCDC, Babawale Afolabi, the convict was arrested on August 30, 2021, around 6:00 a.m. by one Ismaila Ebbo Mohammed and his neighbours at Kibefandi compound, Kaiama.
He said, “According to the complainants, the Fulani boy has been stealing their yams in the farm on a daily basis.
“The suspect, Abubakar, had confessed to having committed the crime and immediately the state commandant NSCDC Kwara State command, CC. Makinde Iskil Ayinla, gave the directive that he should be charged to court.
“Abubakar Bani has been charged to Kaiama Magistrate Court immediately, just as the suspect pleaded guilty to the crimes.
“He was therefore sentenced to six months imprisonment by Magistrate Yusuf Kide for criminal trespass and theft at New Bussa Correctional Service, Niger State.”

The Minister of Finance, Budget and National Planning, Zainab Ahmed, has said the borrowing level for Nigeria is still at 23 per cent of the Gross Domestic Product, adding that government borrowing is sensible and responsible.
Ahmed made the statement while addressing newsmen on the recent rise in the country’s GDP in Abuja on Monday.

The News Agency of Nigeria (NAN) reported that the National Bureau of Statistics (NBS) recently announced a GDP growth of 5.01 per cent for Q2 2021 for the country.
She explained that the government was borrowing to invest in critical infrastructure including power, water, roads and rails required to enhance business productivity in the country.
“We are borrowing with very close consideration to the sustainability of the borrowing. The borrowing level for Nigeria today is still 23 per cent of the GDP.
“I have said it several times that the problem we have in Nigeria is that of revenue and when you look at the countries that are within the peer group with Nigeria, there are some that had 50 per cent growth that is now at about 70 per cent growth.
“We are at 23 despite the escalated borrowing we had to deal with in 2020 also in 2021 to get a good grip on the economic situation that was occasioned by COVID-19 pandemic and in our case due to the crash in crude oil price.
“We are borrowing sensibly. We are also borrowing to invest in critical infrastructure like power, water, roads and rails which are investments that are required to enhance business productivity in the country today.
“These businesses will grow, they will not only pay taxes, they will also employ people. If we don’t do this, we will regress even from where we are today. It is a necessary investment so we are borrowing responsibly.
“We are making sure what we are borrowing is applying to major infrastructure that will return revenue in the near future,” she said.
Under President Muhammadu Buhari’s regime, Nigeria’s debt profile has continued to increase. 
Nigeria’s public debt hit a total of N31.01 trillion at the end of June 2020, according to the Debt Management Office.
This means that between May 2015 and June 2020, five years under President Buhari, the country’s debt rose by N18.89 trillion.
As of the end of June 2015, one month after the present regime came into power, the country’s debt profile stood at N12.12 trillion.
Nigeria’s total public debt stock as of September 2020, increased by over N6 trillion in just one year to N32.2 trillion. This is according to the Nigerian Domestic and Foreign Debt report, recently released by the NBS.
Total external debts for the period ended September 2020 is $31.9 billion compared to $31.4 billion as of June 2020, according to nairametrics.
Total domestic debt rose to N20 trillion as of September 2020 compared to N19.6 trillion as of June 2020.
Nigeria now has an estimated combined total public debt (domestic and foreign) of N32.2 trillion.
This represents an additional N6.01 trillion when compared to N26.21 trillion recorded as of the corresponding period of 2019. Nigeria expects to borrow more in 2021.
The breakdown shows that external debts accounted for 37.82% (N12.19 trillion) of the total debt stock, while domestic debts at N20.04 trillion represented 62.18% of the total.

Unknown Gunmen Kill Fulani Leader In Kwara Community

Unknown gunmen have killed the head of a Fulani village, Alhaji Alhaji Sheidu Madawaki, at Obuh Ruga cattle settlement, Oro Ago kingdom in the Kwara South Senatorial District.
According to information from the security agents, Madawaki was attacked in his residence around 9:30 pm on Sunday by unknown gunmen.

Investigation also disclosed that the deceased paid a courtesy visit to the office of the Nigeria Security and Civil Defence Corps, NSCDC, on August 23, 2021 to establish a partnership with the agency on how to improve and sustain the existing peaceful coexistence in the kingdom, Daily Post reports. 
During his visit to the agency, the Fulani leader stressed the need for the protection of informants and was given an assurance by the civil defence corps.
The newspaper reported that residents of the kingdom are of the view that the assassination of the Madawaki was likely due to his closeness with and his readiness to support security agencies to wipe out criminals in the area.
When contacted, the spokesman for the state police command, Mr Okasanmi Ajayi, in a text message, confirmed the development.
He said the state Commissioner of Police, Tuesday Assayomo, had directed that discreet investigation into the incident be commenced immediately.

E2%80%99s-scrotum-osun Court Remands Woman In Prison For Biting Neighbour’s Scrotum In Osun

An Ile-Ife Magistrates’ Court in Osun State has ordered that a woman, Nifemi Ajayi, who allegedly bit her neighbour on the scrotum, be remanded. 
The police had charged Ajayi with assault, NAN reports.

The prosecution counsel, Sunday Osanyintuyi, told the court that the defendant committed the offence on August 24, around 8:00 p.m. at No 21, Oke-Soda, Ile-Ife.
According to him, the defendant bit the victim, Olayera Boluwaji on his scrotum and his stomach.
He added that the offence contravened the provisions of Section 355 of the Criminal Code, Laws of Osun, 2002.
The defendant, however, pleaded not guilty.
The defence counsel, Philip Fasanmoye, made an oral bail application. He prayed the court to admit his client in the most liberal terms.
Magistrate Olusola Aluko ordered the defence counsel to file a written application for bail while ordering that Ajayi be remanded in Ilesa correctional centre.
The magistrate adjourned the matter until November 15, for bail consideration.

“Your settlement which has to do with a settled nation also is concluded today. For the blood of many that they have wasted, their generations will pay for it.
“Every time the Holy Ghost moves on me in this direction, something happens and I know that I know, in the name of the Lord Jesus Christ whom I serve and whose I am, judgement begins now.”

E2%80%94yoruba We’ll Airlift 8 Igboho’s Aides Released From Nigeria’s Secret Police Detention Out Of Abuja—Yoruba Group

The umbrella body of Yoruba Self-Determination Groups, Ilana Omo Oodua, has accused Department of State Services (DSS) of planning to cover up their “crime against humanity” by detaining innocent Nigerians.
The body expressed its displeasure with the detention of four associates of Yoruba Nation agitator, Sunday Adeyemo, popularly known as Sunday Igboho, in Abuja.

Earlier on Monday, eight out of 12 associates of Igboho who had been illegally detained by the DSS for 60 days were released, remaining four.

Ilana Omo Oodua also said it was already planning to move the eight agitators away from Abuja following their release from detention. 
This was disclosed in a statement issued on Monday by Communications Secretary, Ilana Omo Oodua Worldwide, Maxwell Adeleye, and titled, ’60 Days After Illegal Detention, Incarceration, DSS Releases eight Igboho’s Associates’.
“The Ilana Omo Oodua Worldwide is very unpleased to inform the Yoruba People and all lovers of Freedom that eight out of the twelve Associates of Chief Sunday Adeyemo, fondly called Sunday Ighoho arrested by the men of the Department of State Services (DSS) on July 1st 2021 at Ibadan, Oyo State, have been released.
“The remaining four are still being held in the custody for only God’s known offence(s) but we shall keep fighting for their release within the ambit of the law.
“The eight released are: Abdullateef Ademola, Onaolapo, Tajudeen Irinloye, Diekola Jubril Ademola, Ayobami Donald, Uthman Opeyemi Adelabu, Olakunle Oluwapelumi, Raji Kazeem and Taiwo Opeyemi Tajudeen.
“The four still held are: Amudat Babatunde, Abideen Shittu, Jamiu Oyetunji and Bamidele Sunday.
“We are currently making arrangements towards airlifting those released from Abuja to Lagos.”
