Attorney General of Rivers State v. FIRS & Anor: A misguided Decision By Kola Oyekan

The Federal High Court of Nigeria, sitting at Port Harcourt division presided by His Lordship,  Hon. Justice Stephen Dalyop Pam delivered a 45- page judgment on the 9th August 2021 in an  action instituted by the Attorney General of Rivers State against the Federal Inland Revenue  Service and the Attorney General of the Federation as the 2nd defendant. In this case, the  presiding Judge ignored all the known principles of taxation and the previous judicial decision  which had earlier laid the constitutionality of the Value Added Tax Act to rest. His Lordship  indirectly amended the Constitution of the Federal Republic of Nigeria, 1999 as amended and  effectively put all the tax laws under the control of the plaintiff, the Rivers State.  
The plaintiff prays the Court to nullify the Value Added Tax Act, the Tertiary Education Tax  Act (erroneously referred to as education tax by the plaintiff) Personal Income Tax, Stamp  Duties Act as being unconstitutional null and void. Pages 1 to 33 of the Judgment dealt only  with the processes filed and exchanged by the parties and the preliminary objection raised by  both the 1st and 2nd defendants relating to joinder or misjoinder of parties and the issue of  jurisdiction of the court to entertain the application. The preliminary objections were rightly  resolved in favour of the plaintiff and therefore not necessary for this review.  
The judgement of the Court can be summarized in two sentences. (1) The power of the National  Assembly to make tax laws is limited to taxation of profit, income and capital gains only as  contained in item 7 (a) & (b) of Part II of the Second Schedule to the Constitution and (2) the  Federal Inland Revenue Service (Establishment) Act, Personal Income Tax Act, Value Added  Tax Act, Taxes and Levies ( Approved List for collection) Act among others are null and void being tax laws not specifically mentioned in items 58 and 59 of the Exclusive Legislative List 
(ELL) of the Constitution.
 

There are five (5) fundamental flaws in the judgment which are outlined as follows:  
(1) His Lordship erroneously limited the powers of the National Assembly to impose tax laws  to items 58 and 59 of the ELL. The powers of the National Assembly to make laws extends  beyond the items in the ELL. The ELL contains 68 items but only four (4) items were expressly  referred to as taxes. If this judgment is to be taken seriously, it, therefore, means that all other  tax laws (e.g companies income tax, tertiary education trust fund, withholding tax on  companies petroleum profit tax etc) which were not mentioned in Item 58 & 59 of the ELL are null and void. Again, His Lordship did not consider item 68 of the ELL which provides that ‘  Any matter incidental or supplementary to any matter mentioned elsewhere in this list.’ For  example, the Tertiary Education Trust Fund ( erroneously referred to as ‘education tax by the  plaintiff and His Lordship) is derived from 2% of the assessable profits of all companies  operating in Nigeria, except the profits of companies in the petroleum upstream sectors. The  question now is: If item 59 of ELL includes taxation of profit and 2% of profits of companies  is set aside as “education tax”, then why should such law be declared null and void on the  flimsiest reason that it was not expressly mentioned in the Constitution?  
(2) Another fundamental flaw in the case of the plaintiff which was not noticed by His Lordship  was that the plaintiff did not plead any state law similar to the Value Added Tax Act. May be,  if there were such laws, the issue of double taxation would have arisen. Even with such state  law, His Lordship decision would not have been justified. His Lordship ought to have  considered the case of AG Lagos State v. Eko Hotels Ltd & Anor ((2018) 36 TLRN 1 where the Supreme Court held that the Value Added Tax Act has covered the field and the  Sales Tax Law cannot be enforced as that will amount to double taxation. Although the Lagos  State later enacted the Hotel and Restaurant Consumption Law and smartly inserted a 5% tax  on the goods consumed in hotels and restaurants in Lagos State. Even with this law, the Federal  High Court in The Registered Trustees of Hotel Owners and Managers Association of  Lagos v. Attorney-General of Lagos State & Federal Inland Revenue Service ( Suit No:  FHC/L/CS/360/2018) did not declare the entire Value Added Tax Act null and void but only  exempted the goods consumed within the premises of hotels, restaurant and event centres in  Lagos State from the value-added tax on the ground that items consumed in hotels and  restaurants were not covered by VAT Act.  
(3) In this present case, His Lordship also did not consider the doctrine of covering the field.  Section 4(5) of the Constitution provides that If any Law enacted by the House of Assembly  of a State is inconsistent with any law validly made by the National Assembly, the law made  by the National Assembly shall prevail, and that other Law shall, to the extent of the  inconsistency, be void. His Lordship should have thrown out the case of the Plaintiff since  there was no such State Law in Rivers State in competition with the VAT Act, Capital Gains  Tax Act and Personal Income Tax Act  
(3) The judgment is also self-contradictory. In one breath, His Lordship agreed that the power  of the National Assembly to make tax laws is limited to taxation of profit, income and capital gains only as contained in items 58 & 59 of the ELL and items 7 (a) & (b) of Part II of the  Second Schedule to the Constitution. In another breadth, the court made a U-turn and granted  all the prayers of the plaintiff which among others includes a declaration that Education Tax and Technology levy (which are taxes from profits of corporate bodies registered under the  Corporate and Allied Matters Act, 2020, a federal law, unconstitutional, null and void.  
(4)Another fundamental flaw noticed in the judgment is the first prayer of the Plaintiff seeking  a declaration that the Plaintiff is entitled to be “bestowed” with the power to collect the capital  gains tax, income, or profits of persons in Rivers State. This relief ought to have been struck  out too. At this stage, His Lordship ought to have distinguished between the power to impose a tax and the power to collect tax. The present arrangement in our tax law is that the personal  income tax, capital gains tax, and stamp duties are federal laws imposed by the federal  government while the 36 states of the federation are bestowed with the power to collect the  taxes in respect of individuals in their respective jurisdictions and Rivers state is not an  exception to this arrangement. One then wonders the need for this relief as contained in the  judgment of the court.  
(5) Also the court did not consider section 25 of the Federal Inland Revenue Service  (Establishment ) Act 2007 which provides that the Service shall have the power to administer  all the enactment listed in the first schedule to the Act which includes the VAT Act, Capital  Gains Tax Act, and Personal Income Tax Act. 
Although, the division of taxing powers in the 1999 Constitution does not reflect the principle  of federalism. It is a design that is unfit for the growth of Nigeria. It is safe to conclude that  Nigeria is a unitary system in disguise as federal. However, this mischief cannot be cured by a  judicial decision but by an amendment of the Constitution.

Controversial Islamic cleric, Sheikh Ahmad Gumi, has faulted Nigerian politicians for hiring private jets to attend the wedding of President Muhammed Buhari’s son, Yusuf Buhari on Friday, while hundreds of school children are languishing in bandits’ dens.
Recall that, Yusuf Buhari married Zahra Bayero, the daughter of the Emir of Bichi, Nasiru Bayero, in a grand ceremony held in Bichi, Kano.

The event was attended by Vice President Yemi Osinbajo, former President Goodluck Jonathan, former Vice President Atiku Abubakar, serving and former governors, traditional rulers, as well as prominent personalities from within and outside the country.

According to Daily Post, Sheikh Gumi during a preaching programme at Sultan Bello Mosque in Kaduna stated this, adding that Nigerian politicians hired private jets to attend the president’s son’s wedding, but forgot hundreds of innocent souls languishing in kidnappers’ den across the country.
He said, “Some people are in captivity in bushes dying silently as kidnappers are holding unto them until ransom is paid. Others are suffering from hunger, as it’s everywhere. People are facing all manner of problems, yet politicians spend public funds on private jets.”
Sheikh Ahmad Gumi then asked, “When Prophet Mohammed married off his daughter, who came from Mecca or Yemen? In the entire Medina; no righteous persons to oversee the solemnisation?
“Some politicians are spending money to hire jets to go to a wedding while criminals are holding people to ransom in the bush. The criminals (bandits) are milking the people.
“Some people have never earned N1million in their life, but bandits would demand N10 million. Many people have sold their houses, farms, everything and paid bandits for ransom, yet, some are not lucky to have their loved ones released unto them.”

The cleric decried how politicians corrupted the clergy, saying religious leaders have become subservient to politicians.
“Some religious leaders cannot survive without behaving in a servile manner towards politicians. Politicians have spoilt the clerics. Atrocities are committed in the country but no one can speak up.
“People think only those in the bush (bandits) milk us dry, no! Even our leaders milk us dry. Where did they get the money to hire all these jets?
“In one of the states, some pictures of a dilapidated hospital were sent to me. The roof was blown off and a patient was lying on the bed. That governor is in Kano to attend a wedding.
“How many schools were rehabilitated? The money that should be used to cater for the people is the one they hire private jets to junket around. Are you not also a bandit?
“We vent our anger against ourselves, other tribes. People are left killing themselves because of poor leadership,” Gumi added.

A former Minister of Information and former presidential candidate of the Social Democratic Party, Prof Jerry Gana, has said that the Nigerian currency, Naira, under the Muhammadu Buhari administration, is one of the most useless currencies in the African continent.
Gana added that Nigeria also has the highest number of “miserable people in Africa.”

The SDP candidate stated these on Saturday at a retreat organised by the Kogi Peoples Democratic Party (PDP) Renaissance Group in Abuja.
Gana, also a PDP chieftain said most Nigerians, the majority of them youths, had become “jobless, frustrated and hopeless” as a result of the harsh economic policies of the current administration.
He said, “In the misery index, Nigeria is the highest in Africa. We are the most miserable set of people in Africa because nothing is moving. In fact, our currency is now 100 percent devalued. Nigeria is going through a very difficult time.
“The level of indebtedness in the past few years is such that every Nigerian is now in debt. The Naira is perhaps one of the most useless currencies in Africa today. I have never seen this level of corruption as we have today. In fact, the level of corruption makes the PDP governments look like angels because corruption is now a thousand times worse.”
Speaking on the insecurity in the country, Gana said nowhere was safe, adding that even Katsina, the home state of President Muhammadu Buhari, was bedevilled by banditry.
“Governor Maisari was advocating recently that everyone in Katsina state should get a gun. Do you know where Katsina is? Do you know who comes from Katsina?” he asked.

Police Shoot Dead Two Bandits In Ogun, Recover AK-47 Rifles

Detectives from the Ogun State Police Command have shot dead two bandits who are suspected to be kidnappers in the Onigaari area along the Lagos-Ibadan Expressway.
According to the police on Saturday, the bandits engaged the police in a gun duel at Bere forest in Onigaari area before they were killed.

The hoodlums were six sighted in the forest, and were planning a kidnap operation when they were engaged by the police operatives.
The Police Public Relations Officer, DSP Abimbola Oyeyemi, stated in a release obtained by SaharaReporters that the hoodlums on sighting the policemen, opened fire on them, and a gun battle ensued between them.
He said, “At the end of the encounter, one of the bandits was shot dead on the spot, while others escaped with varying degrees of gunshot injuries.
“Searching the forest further, one of the bandits with bullets wound was arrested in the bush but gave up the ghost a few minutes after.
“Two AK-47 rifles with breech numbers 1983NF1040 and 1987-3-CA-1212 with five rounds of ammunition were recovered from them. The latest rifle recovery makes it four AK-47 rifles recovered by the command within the period of two weeks. Also recovered from them are sachets of tramadol and assorted charms.
“Meanwhile, the Commissioner of Police, Edward Awolowo Ajogun, has ordered for a massive manhunt for the remaining members of the gang. He also appealed to members of the public, especially hospitals not to hesitate to inform the police if anyone with gunshot injuries is seen in their areas.”

E2%80%98head-lice%E2%80%99-infection FACT-CHECK: No Evidence That Kerosene, Insecticide Mixture Treats ‘Head Lice’ Infection

Social media is awash with success stories of do-it-yourself remedies for head lice, a very dreaded disease common among females.
Platforms such as YouTube are replete with videos showing how people reportedly got rid of lice using the various home remedies and urging the public to do the same.
One of such is this user who applied kerosene to a louse placed in a basin. In the video, she proved that kerosene could kill the louse. Another user recently gave the same advice.
Also, groups on Facebook, most especially those with titles such as ‘Do-it-yourself’ ‘Home Remedies’ among others, also are places where claims regarding hair lice are shared.
With over thousands of followers, the group members with such problems seek advice on how to get rid of hair lice and bring up age-long practices such as the application of insecticide to get rid of hair lice. Some also have recommended the use of Kerosene mixed with camphor as a head lice treatment as seen here, here and here.
Others have advised people with this challenge to make use of pain-relieving balm such as ‘Aboniki’ balm on the affected head because of the healing ability of the ointment.
This is despite stories of those who have been killed by these remedies, particularly a corps member in 2019 who applied Sniper insecticide to get rid of head lice in 2019.
Also, in 2020, a young woman was advised by her hairdresser to apply the same insecticide on the scalp of her two daughters to get rid of hair lice. While one died, the other was saved after much effort by medical practitioners.
What is head lice?
According to Medical News Today, head lice (singular louse) are tiny, wingless, parasitic insects that live in human hair. They are a common problem and highly contagious. They can also be hard to get rid of. The eggs are known as nits
They live in the hair on one’s head and feed off the blood from the scalp.
While head lice move from person to person, there is insufficient evidence to prove that it can be transmitted via inanimate objects such as comb, pieces of clothing of the affected persons among others.
However, while it has been said that head lice do not pose a very serious medical threat, they may cause the carrier to be uncomfortable, causing severe itching.
It has also been emphasized that having head lice does not mean the carrier is dirty.
“These pesky creatures don’t fly or jump — they crawl over to the closest head they can find. This is called head-to-head contact, and most people get lice this way. But they also can spread onto hats, helmets, combs, bedding…”
Verification
Dubawa contacted Gogo James Owo, a clinical pathologist with De-Integrated Medical Diagnostics and Research Laboratories, Port Harcourt, Rivers State, who warned strictly against the use of kerosene/camphor, insecticide and other pesticides in getting rid of head lice. He said such home remedies are inimical to health.
“I will advise that people stay away from using Sniper because the active ingredient in Sniper pesticide is Bifenthrin. It is a highly toxic organic pollutant. When bifenthrin gets on the skin, it can cause tingling, itching, burning, or numbness at the site of contact. The sensations usually go away within 48 hours.
“However, inhaling bifenthrin can irritate the nose, throat, and lungs and in severe cases, respiratory damage is observed,” he said.
He also highlighted reasons why kerosene should never be applied to the scalp or any part of the body.
“Kerosene poisoning can cause symptoms in various parts of the body: it can cause breathing difficulty (from inhalation), it may cause throat swelling and the person may develop abdominal pain.
“Exposure to kerosene can also cause a person to start stooling blood, develop low blood pressure, convulsions, coma, dizziness among others.”
He suggested the use of Dimethicone, a highly effective head lice treatment lotion, with a low risk of adverse effects. “Two applications of dimethicone one week apart results in successful eradication of lice in at least 70% of patients. Dimethicone is not an insecticide. It kills lice by suffocation and disrupting their ability to regulate water,” Owo said.
The Center for Disease Control and Prevention also listed pediculicides (lice medicine) as the treatment for head lice.
It also stated that there are many head lice  “over-the-counter” medications.
It noted that over-the-counter products approved by the FDA for the treatment of head lice contain one of the following active ingredients: pyrethrins combined with piperonyl butoxide; permethrin lotion.
Supplemental tips to be followed by people trying to get rid of lice infestations include: washing the hair with shampoo and using a nit comb; vacuuming furniture and floors, washing clothing worn or used by the infested person using hot water as lice and eggs are killed by exposure for 5 minutes to temperatures greater than 53.5°C (128.3°F).
It also warned against fumigant sprays stating, “insecticide sprays are not recommended and can be harmful to people and animals”.
Conclusion
The use of insecticide, kerosene for head lice removal can be dangerous. A person infested with head lice can consult a doctor if the over the counter remedies are not effective.

The Indigenous People of Biafra (IPOB) has stated that Katsina State Governor, Aminu Masari’s call on the residents of the state to bear weapons in defending themselves against the murderous bandits has justified its leader, Nnamdi Kanu.
The group stated that Kanu’s major assignment had been to alert the Nigerian people about defending themselves against attacks by bandits – a quest which made him to form the Eastern Security Network, the IPOB’s militant arm.

IPOB also urged the governors of the South-East region to imbibe Masari’s bold step by instructing residents to bear arms against invaders.
This was contained in a statement issued by the Media and Publicity Secretary of the group, Emma Powerful, obtained by SaharaReporters on Saturday.
Masari had on Tuesday according to a statement issued by his Director-General on Media, Abdu Labaran Malumfashi, urged the people of the state to resolve to self-help against marauders.
Reacting, IPOB’s statement reads, “The attention of the Indigenous People of Biafra (IPOB) has been drawn to the call by Governor Masari of Katsina State, urging residents of the state to acquire arms for self defence against the rampaging Fulani bandits in the state.
“This call by the Katsina State Governor has vindicated our leader Mazi Nnamdi Kanu who has been consistently advising Nigerians and particularly Biafrans to defend themselves against the jihad Fulani terrorists.
“This is a clarion call on South-East Governors who do not understand the tactics and gimmicks which Fulani are playing in their desperation to conquer and islamise the indigenous people living in Nigeria. The politically correct South-East governors and political elite should stop living in the past. They had better wake from their slumber and decode the obvious signals of the call by Masari.
“Let Nigerians prepare because the much talked about Fulani agenda is about to be fully executed. Kanu warned Nigerians but they called him a terrorist instead of appreciating him.
“However, we can assure them that they will not succeed in Biafra land.  We are prepared to repel Fulani in their quest to take over our ancestral land. IPOB is peaceful but they should not dare us or take our peaceful disposition for weakness.”

Police Arrest Bandit Going To Plateau With 53 AK-47 Magazines, 260 Live Ammunition

The Nasarawa State Police Command has arrested a 35-year-old man, Likita Abubakar, who was reportedly conveying 53 AK-47 Magazines and 260 rounds of live ammunition.
Police sources said the suspect was conveying the ammunition to some communities in crisis-ravaged Plateau State.

The Police Public Relations Officer of the command, ASP Ramhan Nansel, told Daily Trust that the suspect was arrested in Akwanga local government area of Nasarawa State.
The joint security operatives in Akwanga, Nasarawa State arrested the suspected bandit with the rounds of ammunition, being conveyed on a motorcycle.

Abubakar was caught by Joint Task Force of the men of the Nasarawa Police Command and operatives of the Federal Road Safety Corps on Saturday.
“According to the information issued by the JTF, the suspect was a Fulani herder identified as Likita, heading to the crisis-laden Jos, the capital city of the neighbouring state, Plateau,” a source said.
Likita, during, interrogation confessed that other members of his gangs numbering six were already on their way via motorcycles to the same destination.
As of the time of filing this report Likita was detained at the Akwanga Police Divisional Headquarters, Nasarawa State.
Plateau was recently placed under curfew due to major security breaches in some parts of the state while students were being evacuated by various states governments to safety.
Three women were killed in Bassa Local Government Area of the state on Thursday despite the presence of security agencies in Jos North LGA.

The actress and producer, who has been in the Nollywood industry for nine years, revealed that she had no idea that the man of God was quite prominent at the time she had an intercourse with him.

Chioma on her Instagram page recalled that the first deal of her encounter of romp s** with the man of God was sealed through a hookup by another lady, Linda Clems, noting that at the second time, she clearly recognised him because they exchanged numbers during the first romp and communicated thereafter.
She said, “Dear @lyndaclems, I have to tell the world about that hookup you arranged between @johnson_suleman_official and myself on the 20th November 2016 in a hotel at Ikeja, the Apostle secretly gave me his number and we had a second meeting at Oriental Hotels Lagos.
“I’m sorry my conscience can’t hold it anymore. I encourage you to tell the truth as a mother and a Christian, to put the devil to shame and save millions of souls being misled. To my family and friends, I am sorry, don’t judge me. Please pray for me so the light of God will continue to expose every work of darkness in my life and the church of God.”
In a video obtained by SaharaReporters, Chioma noted that her public confession came after her spirit continued to torment her, and she needed to make restitution for her sin.

SaharaReporters had also reported in February 2021 that a former pastor of the Omega Fire Ministries, Mike Davids, accused Suleman, of sleeping with his wife.
He had added he was ready to expose the truths behind Stephanie Otobo’s s** scandal.
The case of Otobo, a Canada-based singer, came up in 2017 and 2018 when she accused Suleman of sexual relationship – a controversial scandal that plagued the church and attracted the attention of Nigerians for months.
Davids in a video had noted that he and Suleman both knew how they got Otobo to come to the church in Auchi, and apologise over the scandal and how they persuaded her mother too. Davids had accused Suleman of sleeping with his wife, Faith Edeko, who currently heads an Abuja branch of the church.
He had said, “I left the church (Omega Fire Ministries) of my freewill. You were never the one who sent me out of that ministry. I was tired of your ungodliness as a leader. And that was the major reason I left that ministry. So, forget those manipulations and cheap lies.
“We all know the part I played in the Stephanie Otobo saga. You know as much as I do. How much involved I was in bringing that saga to a halt. I don’t even need to mention names. You knew how we got Stephanie Otobo to come to the altar and apologise to mama (Suleman’s wife) and brought Stephanie Otobo’s mother to Auchi.
“I am coming to that issue because you are pushing me to that extent, Apostle Johnson Suleman as much as I knew what happened. Thirdly, I am also aware that my account has been frozen. You have also released policemen to get me arrested.
“You have 48 hours to ask those who are blocking my account to unblock it. You will not like what is going to follow.” 
In January 2018, Otobo accused Suleman of impregnating her and breaching a promise to marry her.
She claimed she had s** romps with the pastor in Italy, New York and Nigeria.

Suleman denied the allegations and threatened to sue SaharaReporters for reporting the story.
He also threatened Festus Keyamo, whose law office in Lagos represented Otobo, demanding an apology and the payment to him of N1 billion for blackmail and injury.
Otobo however said she had pictures of him exposing his private parts, evidence of which it said would emerge in court.
In March 2017, SaharaReporters also released a report on how Suleman, who was at the center of an adultery scandal, gave a $76,000 brand-new Mercedes-Benz 450 GL to Nollywood star Daniella Okeke in 2016.
Ms. Okeke was previously named by Otobo, Apostle Suleman’s estranged lover, as being one of the other women in his life.
For her part, the actress in 2016 proudly displayed the Mercedes-Benz SUV GL 450 on her Instagram page in front of a brand-new house where she parked it.
After her name was revealed by Otobo at a press conference covered extensively by SaharaReporters, some Nigerians invaded Ms. Okeke’s Instagram questioning the source of her wealth given that she had not featured in any prominent movies in recent years.
The more inquisitive among them took advantage of a new website for vehicle registration in Lagos State which unveils the ownership of any vehicles by its number due to a bug on the web page, and discovered that one of Okeke’s most prized possessions, the posh Mercedes-Benz car, was registered to “Apostle Suleman Johnson.”

E2%80%99s-detention IPOB Supporters March To British, Kenya Embassies, Protest Nnamdi Kanu’s Detention

Supporters of Biafra and members of the Indigenous People of Biafra in Germany staged a protest to the British and Kenyan embassies in the country over the continued detention of its leader, Nnamdi Kanu, by the Nigerian government.
SaharaReporters obtained a video where the protesters gathered in numbers and began the protest march to the two embassies.

The agitators mostly clad in Biafra attires were seen waving the flags and calling passers-by and announcing the beginning of the march to demand the release of the IPOB leader, Nnamdi Kanu who has been in the custody of the Department of State Services (DSS) in Nigeria since June.
Some protesters carried placards with #FreeNnamdiKanu which revealed the intent of the march on Saturday morning.
Kanu was arrested by the Kenyan security operatives and extradited to Nigeria in June. He appeared briefly before Justice Binta Nyako of the Federal High Court, Abuja.
The separatist leader was charged by the Nigerian government with allegations of terrorism, treason among others.
His next trial is on October 21, as the operatives of DSS failed to bring him to court on July 26, forcing Nyako to adjourn.
Kanu has been at loggerheads with the Nigerian government.
He demanded a sovereign state, alleging that the President Muhammadu Buhari government was guilty of aiding and abetting Fulani herdsmen in the South-East.

A Port Harcourt-based lawyer, Francis Echianu, has filed a petition at the Police Service Commission (PSC), against two police officers, ASP Jamiu Olaigbe and Inspector Ati Jonah, for detaining him with a forged court warrant in collaboration with one of his cousins, Chidi Echianu.
He alleged that the two policemen on the instruction of his cousin, Chidi, who is based in Germany, arrested him, his younger brother, Chijioke, and his 78-year-old father Meshack Echianu, in a Gestapo manner and subjected them to degrading treatments.

He said he was detained for 14 days at the Asokoro Police Station Abuja in December 2020 on trumped up allegations of threat to life which his cousin made through a petition.
He urged the commission to investigate and prosecute the two policemen involved in his arrest and detention.
The petition reads in part “On the 24th day of December 2020 in my village, Umuogbu Durunogbu Osina, in the Ideato North Local Government, Imo State, my cousin Mr. Chidi Ahamefuna Echianu, brought in from Abuja, one ASP Jamiu Olaigbe and Inspector Ati Jonah to arrest me, my father (Chief Meshack) and my junior brother Chijioke Echianu on a frivolous allegation that we threatened his life. 
“My cousin Chidi Echianu further instructed ASP Jamiu Olaigbe and Inspector Ati Jonah in my presence to ensure that myself, my father Chief Meshack Echianu and my junior brother Chijioke Echianu were detained in Abuja until we packed out from the family house which my father Chief Meshack Echianu built with his hard earned money. 
“On December 24, the said ASP Jamiu Olaigbe and Inspector Ati Jonah carried out the unlawful instruction of Chidi Ahamefuna Echianu and moved me, my father and my junior brother to Abuja where they detained us at the Asokoro Police Station, Abuja, instead of the Force Headquarters, Edet House, Abuja.
“That on the 29th day of December 2020, the said ASP Jamlu Olaigbe and Inspector Ati Jonah under the Instruction of Chidi Echianu went behind and obtained a forged detention warrant purportedly from an Upper Area Court, Karu, Nasarawa State and same was served on me, by Inspector Jonah on December 31, 2020. The copy of the forged detention warrant Is hereby attached to this application for ease of reference.” 
He said while he was in detention, a journalist approached the Upper Area Court, New Karu, Nasarawa State, to inquire the source of the purported detention warrant  but was informed by the registrar of the court that the said detention warrant was fake.
“Our counsel, Alozie Nmerengwa, deposed an affidavit of facts at the Abuja High Court to corroborate the aforementioned information as same as information within his personal knowledge and same is attached to this application for ease of reference. 
“That my Father Chief Meshack Echianu, my Junior brother Chijioke Echianu and my humble self were detained at Asokoro Police Station for 14 days without being arraigned before a court of competent jurisdiction because of the illegal conspiracy between my cousin and the policemen,” he added.
