Why Supreme Court Upturned Ihedioha’s Victory

The Supreme Court has given reasons why it nullified the governorship election of Imo State and allowed the appeal filed by Hope Uzodinma of All Progressives Congress. The seven-man panel led by Chief Justice of Nigeria, Tanko Muhammad,  agreed that results in 388 polling units were unlawfully excluded during the collation of the final governorship election result in Imo State. The apex court noted that the result from the 388 polling units indicated that Uzodinma polled majority of the lawful vote and ought to have been declared winner of the election by the electoral body.
Justice Kudirat Kekere-Ekun, who read the unanimous judgment of the apex court, said, “Votes due to the appellant, Senator Hope Uzodinma, and APC from 388 polling units were wrongly excluded from scores ascribed to the appellant (to them).
“It is thereby ordered that the votes from 388 polling units unlawfully excluded from the appellant declared shall be added and that the first respondent, Emeka Ihedioha, was not duly elected by a majority of lawful votes cast at the said election.
“His return as the elected governor of Imo State is hereby declared null and void and accordingly set aside.
“It is hereby declared that the first appellant (Mr Uzodinma) holds the majority of lawful votes cast at the governorship election held in Imo State on March 9, 2019, having satisfied the mandatory constitutional requirement.”It is hereby declared that first appellant, Senator Hope Uzodinma, is winner of the governorship of Imo State held on March 9, 2019.
“The certificate issued to Ihedioha is hereby withdrawn. It is hereby ordered that the certificate of return shall be issued to the first appellant, Senator Hope Uzodinma, forthwith and he should be sworn in as governor of Imo State.”Uzodinma had asked the court to set aside the decision of the election petition tribunal and declare him winner of the election or in the alternative order a rerun.Three governorship candidates had filed separate appeals against the judgment of the Imo State Governorship Election Petition Tribunal, which upheld the election of Ihedioha. The candidates include Ifeanyi Ararume  of All Progressive Grand Alliance, Uche Nwosu of Action Alliance, and Hope Uzodinma of All Progressives Congress.

Kidnappers Demand N100m Ransom For 58 Persons Abducted In Southern Kaduna

Armed Bandits, who sacked 10 communites in Chikun and Birnin Gwari local government areas of Kaduna State have asked for a ransom of N100m to free 58 hostages they had held since January 6, 2020.
The revelation was made by Jonathan Asake, President of Southern Kaduna Peoples Union, when he visited a camp of displaced persons from the attack at the uncompleted Community Secondary School, Unguwan Bije, Gonin Gora.
Habila Sarkin Noma Rumana, a pastor and leader of the displaced community, said the attackers are well known to the security in the state and are Fulani.
He said, “We have been under attack in the past but we always find ways of surviving them. What we know is that the attackers are well armed and are Fulani.
“They would graze on our crops and threaten to kill us if we protest. Sometimes they would attack and take captives. We will manage and pay ransoms. Even after paying, sometimes they kill the victims.
“But the ones that took place on January 6, 2020 was the worst. Hundreds of armed gunmen invaded about 10 of our villages at the same time. They carried out deadly attacks and looted our villages.
“At the last count, between 34 to 36 people were killed. In fact, 58 people were kidnapped from what the kidnappers said. But we still can’t account for many, they are hiding in the forest and bushes.”
Rumana said the kidnappers called to demand N100m in ransom if the abducted people are to return home alive.
He added, “The kidnappers have called. They say we must produce N100m as ransom if we want to have them alive. I don’t know how they expect us to raise that money.
“They stole our cattle, looted our valuables, stole and burnt our grains. We escaped by the grace of God.”
President of SOKAPU called on the Nigerian Government to urgently save the people of Southern Kaduna from the attacks he said were deliberate.
He also called on the international community and non-governmental organisations to assist with aid.

Supreme Court Adjourns Hearing Of Bauchi, Benue and Plateau Appeals Indefinitely

The Supreme Court has adjourned the hearing on the appeals challenging the results of governorship elections in Bauchi, Benue and Plateau states indefinitely.
Chief Justice of Nigeria, Ibrahim Tanko Muhammad, made the announcement on Tuesday in Abuja.
He said that the court would communicate the new date to the parties involved in the case.
The adjournment was to enable the apex court attend and give preference to the appeals that would expire on January 17 and 20 respectively.
Addressing journalists, counsel to Plateau State governorship candidate of Peoples Democratic Party, Mike Ozekhome, said that the adjournment was at the instance of some critical appeals that must be determined between now and Friday.
He said that those appeals must be taken in line with the constitution’s provision that stipulated the period and time frame for election petition.
Ozekhome said, “Those appeals that are expiring on 17 and 20 must be taken and given preference.
“Our own for example the General J.T Useni Vs INEC and Lalong is expiring on January 28. So it should not rob shoulders in terms of time management with appeals that are expiring this Friday.”
He expressed displeasure at the lukewarm attitude of the government for not increasing the justices of Supreme Court to 21 instead of 15 sitting on those appeals.
He said this would further reduce the workload on the panel of the court.
